These Terms and Conditions apply to all bookings made with KETHEESKANTH LTD trading as Vaarom Chauffeurs. Please read them carefully before using our website or services.

These Terms and Conditions apply to all bookings made with KETHEESKANTH LTD trading as Vaarom Chauffeurs ("Vaarom Chauffeurs", "we", "us", or "our").

Please read these Terms and Conditions carefully before using our website, making a booking, or using our private hire transportation services.

By using our website, requesting a quotation, making a booking, or proceeding with a journey, you confirm that you accept these Terms and Conditions and agree to be bound by them.

KETHEESKANTH LTD trading as Vaarom Chauffeurs is a private hire operator based in London, United Kingdom. All services are provided subject to applicable UK law, the Private Hire Vehicles (London) Act 1998, the Private Hire Vehicles (London) (Operators' Licences) Regulations 2000, Transport for London ("TfL") licensing requirements, and any other applicable regulations.

1. Definitions

In these Terms and Conditions:

  • "Booking" means a private hire booking accepted by Vaarom Chauffeurs.
  • "Customer", "you", or "your" means the person making the booking and/or the person receiving the transportation services.
  • "Passenger" means any person travelling in the vehicle.
  • "Driver" means the licensed private hire driver assigned to carry out the journey.
  • "Vehicle" means the licensed private hire vehicle assigned to the booking.
  • "Journey" means the transportation service requested by the Customer and confirmed by Vaarom Chauffeurs.
  • "Booking Confirmation" means the confirmation sent by Vaarom Chauffeurs by email, SMS, WhatsApp, phone, or another agreed communication method.

2. Booking Contract

When Vaarom Chauffeurs accepts your booking, a contract is formed between you and KETHEESKANTH LTD trading as Vaarom Chauffeurs for the provision of the booked journey.

Vaarom Chauffeurs enters into this contract as principal, not merely as an agent for the driver. This means Vaarom Chauffeurs is responsible for accepting the booking and arranging the transportation service that is the subject of the booking.

No contract is formed until Vaarom Chauffeurs has accepted the booking and issued a booking confirmation or otherwise confirmed the booking to you.

All bookings are subject to vehicle and driver availability.

3. Private Hire Only

Vaarom Chauffeurs provides pre-booked private hire services only.

Our vehicles cannot be hailed in the street, picked up from taxi ranks, or hired without a prior booking accepted by Vaarom Chauffeurs.

Passengers must not attempt to make separate or direct arrangements with a driver for a private hire journey outside a booking accepted by Vaarom Chauffeurs.

4. Booking Information and Accuracy

You are responsible for providing complete and accurate booking information, including:

  • The full pickup address or pickup location.
  • The full destination address.
  • The correct date and time of pickup.
  • Passenger name and contact number.
  • Flight, train, ferry, cruise, or event details where relevant.
  • The number of passengers.
  • The amount, size, and type of luggage.
  • Any special requirements, including child seats, accessibility needs, additional stops, or meet-and-greet requirements.

Vaarom Chauffeurs shall not be responsible for delays, missed journeys, missed flights, missed trains, missed ferries, missed connections, additional charges, or any other loss arising from incorrect, incomplete, or misleading information provided by the Customer.

5. Booking Confirmation

Once your booking is accepted, we will provide a booking confirmation by email, SMS, WhatsApp, telephone, or another appropriate communication method.

Where required or available, the booking confirmation may include details such as the vehicle registration mark, driver's first name, driver licence details, vehicle details, pickup location, pickup time, journey details, and fare information.

You must check the booking confirmation carefully and notify us immediately if any details are incorrect.

6. Prices, Fares and Payment

The fare will be agreed or estimated at the time of booking.

Unless otherwise stated, quoted prices apply only to the journey details provided at the time of booking. Additional charges may apply for waiting time, extra stops, route changes requested by the Customer, parking, airport pickup charges, tolls, congestion charges, ULEZ or other road charges, additional mileage, extra luggage, vehicle upgrades, or any service not included in the original booking.

Where a fixed price has been agreed, it is based on the pickup, destination, route, passenger number, luggage details, and timing provided at the time of booking. If these details change, the fare may be recalculated.

Payment must be made by the method agreed at the time of booking. Where payment is due in advance, the booking may not be confirmed until payment has been received.

If payment is to be collected by the driver, the driver collects payment on behalf of Vaarom Chauffeurs.

7. Booking Amendments and Rescheduling

You may request changes to your booking by contacting Vaarom Chauffeurs as soon as possible.

Customers may reschedule a booking free of charge if the request is made more than 90 minutes before the scheduled pickup time, subject to vehicle and driver availability.

Changes requested within 90 minutes of the scheduled pickup time may be refused or may incur additional charges. This may include costs incurred by Vaarom Chauffeurs or the assigned driver, including waiting time, travel time, parking, or other reasonable expenses.

Any amendment is not confirmed until Vaarom Chauffeurs has accepted it.

8. Cancellations and No-Shows

If you wish to cancel a booking, you must contact Vaarom Chauffeurs as soon as possible.

Cancellation charges may apply depending on the notice given, the type of journey, the vehicle allocated, and any costs already incurred.

A passenger may be treated as a no-show if they fail to attend the agreed pickup location within the permitted waiting time and do not contact Vaarom Chauffeurs or the driver.

In the event of a no-show, the booking may be charged in full, including any waiting time, parking, airport charges, tolls, or other costs incurred.

For airport, port, railway station, event, and long-distance bookings, cancellation charges may be higher where the vehicle has already been dispatched or the driver is already on route.

Your statutory rights are not affected.

9. Airport, Port and Railway Station Pickups

For airport, port, railway station, and similar pickups, the Customer is responsible for providing accurate arrival details, including flight, train, ferry, or cruise number where applicable.

Vaarom Chauffeurs may monitor flight arrival information where flight details have been provided. No additional waiting charge will be applied solely because of a flight delay outside your control, provided the correct flight details were given at the time of booking.

For airport, port, and railway station pickups, a complimentary waiting time of 60 minutes is provided from the scheduled pickup time or, where applicable, from the agreed pickup time after arrival.

For all other pickups, a complimentary waiting time of 30 minutes is provided from the scheduled pickup time.

Waiting time beyond the complimentary period may be charged at our applicable waiting rate. Additional parking or airport charges may also apply.

You are responsible for locating the designated pickup point provided in your booking confirmation. If you cannot locate your driver, you must contact Vaarom Chauffeurs immediately using the contact details provided.

Failure to contact us may result in the booking being treated as a no-show.

10. Journey Time, Routes and Delays

Any journey time, arrival time, mileage, or route estimate provided by Vaarom Chauffeurs is for guidance only.

You are responsible for selecting a pickup time that allows sufficient time for your journey, including check-in times, airport security, immigration, event entry, traffic, roadworks, diversions, weather, public transport disruption, road closures, security incidents, accidents, and other potential delays.

The driver may choose the route they reasonably consider most suitable at the time of travel. This may not always be the shortest route.

If you request a different route, additional stops, or a diversion from the original booking, extra charges may apply.

Vaarom Chauffeurs is not liable for missed flights, trains, ferries, cruises, appointments, meetings, events, or other connections where delays are caused by circumstances outside our reasonable control or by insufficient journey time allowed by the Customer.

11. Passenger Responsibilities

Passengers must be ready at the agreed pickup time and location.

Passengers must behave in a safe, lawful, and respectful manner towards the driver, vehicle, other passengers, members of the public, and Vaarom Chauffeurs staff.

Passengers must not smoke, vape, consume illegal substances, misuse alcohol, damage the vehicle, distract the driver, behave aggressively, or act in any way that may affect the safety of the journey.

Passengers must wear seat belts where required by law.

Passengers must ensure that children are properly supervised at all times.

The driver may refuse to carry any passenger who, in the driver's reasonable opinion, appears to be under the influence of alcohol or drugs, behaves abusively or dangerously, poses a risk to safety, or may damage the vehicle.

If transport is refused due to passenger conduct, the booking may still be charged in full.

12. Luggage

Each vehicle has a specific luggage capacity. You must provide accurate luggage details at the time of booking.

Passengers must not exceed the luggage allowance or vehicle capacity confirmed at the time of booking.

If the luggage exceeds the safe or legal capacity of the vehicle, the driver may refuse to carry some or all of the luggage. This is for the safety of passengers, the driver, and the vehicle.

Where additional luggage cannot be accommodated, Vaarom Chauffeurs may arrange an additional or larger vehicle, subject to availability. Any additional cost will be payable by the Customer.

Passengers remain responsible for their own luggage and personal belongings at all times. Vaarom Chauffeurs is not responsible for loss, theft, or damage to luggage or personal property unless caused by our proven negligence.

Valuable items should not be left unattended in the vehicle.

13. Vehicle Condition and Cleaning Charges

Passengers must treat the vehicle with care and respect.

Any fouling, soiling, vomiting, spillages, staining, damage, or unreasonable mess caused by a passenger may result in a cleaning charge.

The minimum cleaning charge is £60. A higher charge may apply depending on the severity of the fouling, specialist cleaning required, loss of driver earnings, or time the vehicle is unavailable for further bookings.

The Customer who made the booking will be responsible for any cleaning or damage charges caused by any passenger travelling under that booking.

14. Child Seats

Child seats may be requested at the time of booking and should be specified clearly in the booking notes.

Vaarom Chauffeurs will make reasonable efforts to provide requested child seats, subject to availability.

The Customer is responsible for ensuring that any child seat is suitable for the child's age, height, weight, and needs, and that the child is safely secured.

Where a Customer provides their own child seat, the Customer is responsible for fitting and using it correctly.

Vaarom Chauffeurs accepts no liability for the suitability, fitting, or use of child seats except where required by law.

15. Accessibility and Special Requirements

Customers should inform Vaarom Chauffeurs at the time of booking of any accessibility needs, mobility aids, assistance requirements, medical considerations, or other special requirements.

We will make reasonable efforts to accommodate such requests, subject to vehicle suitability, driver availability, and safety requirements.

If a passenger requires a specific type of vehicle or assistance, this must be confirmed by Vaarom Chauffeurs before the booking is accepted.

16. Subcontracting

Vaarom Chauffeurs may subcontract a booking to another appropriately licensed private hire operator where necessary due to operational requirements, vehicle availability, disruption, or other circumstances.

Where a booking is subcontracted, Vaarom Chauffeurs will take reasonable steps to ensure that the partner operator is reputable and properly licensed by the relevant authority.

The contract between the Customer and Vaarom Chauffeurs remains in place unless otherwise stated.

17. Vehicle Allocation

We will make reasonable efforts to provide the vehicle type requested at the time of booking.

However, vehicle allocation is subject to availability. We may provide a larger or equivalent vehicle where necessary.

If a specific vehicle model, colour, make, or luxury category is essential, this must be agreed by Vaarom Chauffeurs in writing before the booking is confirmed.

18. Force Majeure and Events Outside Our Control

Vaarom Chauffeurs shall not be liable for any failure or delay in performing our obligations where such failure or delay is caused by events beyond our reasonable control.

Such events may include, but are not limited to, adverse weather, heavy traffic, road traffic accidents, road closures, vehicle breakdowns, police activity, security alerts, terrorism, war, civil unrest, demonstrations, strikes, public transport disruption, airport disruption, pandemics, epidemics, natural disasters, technical failures, acts of government, or any other circumstances outside our reasonable control.

In such circumstances, Vaarom Chauffeurs may cancel, delay, amend, reschedule, or apply reasonable additional charges to a booking.

19. Limitation of Liability

Nothing in these Terms and Conditions limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

Subject to the above, Vaarom Chauffeurs shall not be liable for any indirect, consequential, financial, business, professional, or personal losses, including loss of profit, loss of business, loss of opportunity, missed flights, missed trains, missed ferries, missed cruises, missed meetings, missed events, or missed connections.

Vaarom Chauffeurs shall not be responsible for losses arising from inaccurate booking information, passenger delay, failure to attend the pickup location, failure to contact us when unable to locate the driver, excessive luggage, unsafe passenger conduct, or circumstances beyond our reasonable control.

20. Website Use

The information on our website is provided for general information and booking purposes only.

We make reasonable efforts to keep the website accurate and up to date, but we do not guarantee that all content will always be complete, accurate, or available.

You must not misuse our website by introducing viruses, attempting unauthorised access, interfering with website functionality, sending spam, copying content without permission, or using the website for unlawful purposes.

We may suspend, restrict, or terminate access to our website where misuse is suspected.

21. Discounts, Offers and Promotions

Any discount, offer, or promotional code is subject to availability and any specific terms stated at the time of issue.

Only one discount or promotional code may be used per booking unless we expressly agree otherwise.

Discounts and offers cannot be exchanged for cash and may be withdrawn or amended at any time.

22. Direct Driver Contact and Private Arrangements

All bookings must be made through Vaarom Chauffeurs.

Customers must not contact drivers directly to arrange private hire journeys outside Vaarom Chauffeurs' booking system.

Any journey arranged directly with a driver without acceptance by Vaarom Chauffeurs is not a Vaarom Chauffeurs booking, is not covered by these Terms and Conditions, and may not be lawful private hire work.

Vaarom Chauffeurs accepts no responsibility for any loss, damage, injury, dispute, or regulatory issue arising from private arrangements made directly with a driver.

23. Complaints and Customer Service

If you have a complaint about our service, please contact Vaarom Chauffeurs as soon as possible.

Please provide your booking reference, journey date, passenger name, contact details, and a clear description of the issue.

We aim to acknowledge and investigate complaints promptly and, where possible, respond within 24 hours. Some complaints may take longer to investigate depending on their nature.

Passengers may also have the right to raise service-related issues with Transport for London where relevant.

24. Data Protection and Privacy

Vaarom Chauffeurs is committed to protecting your personal data in accordance with applicable UK data protection laws, including the UK GDPR and the Data Protection Act 2018.

We collect and use personal information for purposes including processing bookings, providing journeys, contacting passengers, taking payment, managing complaints, complying with legal and regulatory obligations, and improving our services.

We may share information with drivers, subcontracted operators, payment providers, insurers, professional advisers, regulators, law enforcement, or other third parties where necessary for providing our services or complying with legal obligations.

We will not sell your personal data.

25. Marketing Communications

Where permitted by law, we may contact you with service updates, feedback requests, offers, or marketing communications.

You may opt out of marketing communications at any time by using the unsubscribe link where provided or by contacting us directly.

Service-related messages about an existing booking may still be sent even if you opt out of marketing communications.

26. Changes to These Terms

Vaarom Chauffeurs may update these Terms and Conditions from time to time.

The version published on our website at the time of booking will apply to that booking unless changes are required by law or regulation.

You should review these Terms and Conditions regularly.

27. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by the laws of England and Wales.

The courts of England and Wales shall have jurisdiction over any dispute, subject to any mandatory consumer rights that may apply.
